As a front-line manager, you play a vital role in maintaining compliance and ethical practices within the departments you oversee at the dealership. As the second line of defense, you supervise the first line defense–the employees who engage directly with customers, facilitate vehicle financing, sell products and services, and support dealership functions. Your leadership establishes the benchmark for accountability, ensuring compliance is fundamental to daily operations.
Regulatory bodies, such as the Federal Trade Commission (FTC), stress the necessity of “effective training” to guarantee that employees comprehend their duties and comply with legal and ethical standards. Compliance transcends mere rule-following; it is about protecting customers, upholding dealership integrity, and minimizing risks that may result in financial penalties or damage to reputation.
Your responsibility as a front-line manager is crucial for nurturing a culture of compliance. By actively applying these principles, you contribute to safeguarding both the dealership and its customers, while promoting a workplace founded on integrity, accountability, and trust.
This training helps you in three ways.
The first line of detense are the dealership employees who arrange leasing or financing for vehicles, sell products and services, or operationally support customers. The employees must understand their roles and be accountable to make ethical and legal decisions. Dealers are responsible for providing what the FTC has noted as 'effective training.'
The second line of defense is the risk-related monitoring and auditing functions. The middle-line managers are responsible for proactively monitoring and auditing employee behaviors to ensure that the policies, procedures, and practices comply with legal expectations. They report data breaches and perceived non-compliance activities to the Dealership Compliance Officer.
The third line of defense are the auditors and agencies who independently evaluate the dealer's compliance risks and controls. This includes external resources and 3rd party vendors. The compliance officer is responsible for reporting risk issues to the dealer principal and senior management, along with suggested steps for mitigation.
